accommodation process. \par \hich\af2\dbch\af31505\loch\f2 To ensure successful return\_to\_work. \par \hich\af2\dbch\af31505\loch\f2 And then to increase your knowledge of resources of the U.S. Department of Labor, and al\hich\af2\dbch\af31505\loch\f2 so State and local resources, \par \hich\af2\dbch\af31505\loch\f2 Such as the Shirley Ryan 嫩B研究院 and the research and training center on rehab outcomes. \par \hich\af2\dbch\af31505\loch\f2 Next slide. \par \hich\af2\dbch\af31505\loch\f2 So really our society is challenged by all of the millions of American workers leaving the workforce every year \par \hich\af2\dbch\af31505\loch\f2 After ex\hich\af2\dbch\af31505\loch\f2 periencing an injury or illness. \par \hich\af2\dbch\af31505\loch\f2 Hundreds of thousands of these workers go onto receive State and Federal disability benefits. \par \hich\af2\dbch\af31505\loch\f2 And many could remain in their jobs or in the workforce if they received timely, effective support to prevent \par \hich\af2\dbch\af31505\loch\f2 A work disability. \par \hich\af2\dbch\af31505\loch\f2 Next slide. \par \hich\af2\dbch\af31505\loch\f2 So the follow\_on effects really are \_\_ they are major losses to the employers. \par \hich\af2\dbch\af31505\loch\f2 Employers end up shouldering the direct and indirect costs that come with a loss of a valuable employee. \par \hich\af2\dbch\af31505\loch\f2 All levels of government face reductions in tax base, decre\hich\af2\dbch\af31505\loch\f2 ased economic activity, and hundreds of thousands \par \hich\af2\dbch\af31505\loch\f2 Of workers go onto receive state and federal disability benefits. \par \hich\af2\dbch\af31505\loch\f2 However, many injured and ill workers could remain on the jobs or in the workforce if they received timely effective help. \par \hich\af2\dbch\af31505\loch\f2 And the losses t\hich\af2\dbch\af31505\loch\f2 o the employees are: That they lose their health oftentimes. \par \hich\af2\dbch\af31505\loch\f2 Their family finances, and ultimately their quality of life. \par \hich\af2\dbch\af31505\loch\f2 Compared to people without disabilities, individuals who have disabilities are significantly less likely \par \hich\af2\dbch\af31505\loch\f2 To engage in future work. \par \hich\af2\dbch\af31505\loch\f2 Those who do work earn less and are much more likely to be poor. \par \hich\af2\dbch\af31505\loch\f2 We could go to the next slide. \par \hich\af2\dbch\af31505\loch\f2 The National Safety Council reports that the total cost of work injuries in 2018 was $170.8 billion. \par \hich\af2\dbch\af31505\loch\f2 This includes wage losses of $52.4 billion and medical expe\hich\af2\dbch\af31505\loch\f2 nses of $35 billion and expenses of $57 billion. \par \hich\af2\dbch\af31505\loch\f2 Days lost totals to $70 million. \par \hich\af2\dbch\af31505\loch\f2 This includes disabling injuries including the day of the injury, follow}{\rtlch\fcs1 \ab\af2 \ltrch\fcs0 \b\insrsid14489604 \hich\af2\dbch\af31505\loch\f2 }{\rtlch\fcs1 \ab\af2 \ltrch\fcs0 \b\insrsid344108 \hich\af2\dbch\af31505\loch\f2 up and the injured persons return to work. \par \hich\af2\dbch\af31505\loch\f2 The next slide, please. \par \hich\af2\dbch\af31505\loch\f2 Even beyond really these staggerin\hich\af2\dbch\af31505\loch\f2 g numbers specific to losses due to work injury. \par \hich\af2\dbch\af31505\loch\f2 There's also a very strong business case for retaining workers with disabilities. \par \hich\af2\dbch\af31505\loch\f2 And that's been building over the past few decades. \par \hich\af2\dbch\af31505\loch\f2 One of the most recent reports is a report that was put out through ACCEN\hich\af2\dbch\af31505\loch\f2 TURE in 2018. \par \hich\af2\dbch\af31505\loch\f2 Tangible benefits including increases innovation, improved productivity and a better work environment. \par \hich\af2\dbch\af31505\loch\f2 Companies known for hiring and retaining injuries with disabilities. \par \hich\af2\dbch\af31505\loch\f2 And on average over a four\_year period found these companies had a 28 \hich\af2\dbch\af31505\loch\f2 percent higher revenue. \par \hich\af2\dbch\af31505\loch\f2 Double the net income and 30 percent higher economic profit margins than those companies which were not disability inclusive. \par \hich\af2\dbch\af31505\loch\f2 Go to the next slide, please. \par \hich\af2\dbch\af31505\loch\f2 So early stay\_at\_work and return\_to\_work strategies and programs really succ\hich\af2\dbch\af31505\loch\f2 eed in returning injured workers \par \hich\af2\dbch\af31505\loch\f2 To productivity as soon as medically possible. \par \hich\af2\dbch\af31505\loch\f2 This is what we should all be working towards in order to prevent needless disability. \par \hich\af2\dbch\af31505\loch\f2 These strategies involve early action and coordination between ill and injured workers. \par \hich\af2\dbch\af31505\loch\f2 Employers, healthcare workers like yourself, and employment services professionals. \par \hich\af2\dbch\af31505\loch\f2 While disability cash and health benefits are essential for protecting workers who have been incapacitated \par \hich\af2\dbch\af31505\loch\f2 With long\_term and permanent disabilities, they should really no\hich\af2\dbch\af31505\loch\f2 t be the default path if viable options for return \par \hich\af2\dbch\af31505\loch\f2 Or even partial return to work exists. \par \hich\af2\dbch\af31505\loch\f2 By keeping workers engaged in gainful employment, as taxpaying members of the community, \par \hich\af2\dbch\af31505\loch\f2 Fewer individuals will need to apply for disability benefits. \par \hich\af2\dbch\af31505\loch\f2 And the worke\hich\af2\dbch\af31505\loch\f2 rs, their families and their employers will all benefit. \par \hich\af2\dbch\af31505\loch\f2 Improving return\_to\_work and stay at work outcomes is a win\_win policy for all stakeholders. \par \hich\af2\dbch\af31505\loch\f2 The next slide, please. \par fundamental reason for most medically\_related lost workdays and lost jobs is not medical necessity. \par \hich\af2\dbch\af31505\loch\f2 But t\hich\af2\dbch\af31505\loch\f2 he nonmedical decision making involved, and the poor functioning of a little\_known but fundamental practice. \par \hich\af2\dbch\af31505\loch\f2 The stay\_at\_work and return\_to\_work process. \par \hich\af2\dbch\af31505\loch\f2 That's what I'm going to focus on and talk about today really. \par \hich\af2\dbch\af31505\loch\f2 Is about this nonmedical decision\_makin\hich\af2\dbch\af31505\loch\f2 g that really bridges your role and your contributions to the SAW and RTW process. \par \hich\af2\dbch\af31505\loch\f2 With those that are working with the person to return to work. \par \hich\af2\dbch\af31505\loch\f2 If we can go to the next slide. \par \hich\af2\dbch\af31505\loch\f2 And what I'm really speaking of the non\_medical decision making we're really t\hich\af2\dbch\af31505\loch\f2 alking about the non\_\_ \par \hich\af2\dbch\af31505\loch\f2 I'm sorry I think I'm one slide ahead. \par \hich\af2\dbch\af31505\loch\f2 Apologies for that. \par \hich\af2\dbch\af31505\loch\f2 If you could go one more slide? There we are. \par \hich\af2\dbch\af31505\loch\f2 There we are. \par \hich\af2\dbch\af31505\loch\f2 Sorry, I'll be a little more focused and try to keep us on task. \par \hich\af2\dbch\af31505\loch\f2 So when I speak of the nonmedical decision\_makin\hich\af2\dbch\af31505\loch\f2 g, we're really speaking of the nonclinical role of the medical professionals. \par \hich\af2\dbch\af31505\loch\f2 Paramount to this is the medical professionals positively framing the stay\_at\_work and return\_to\_work program from the very beginning. \par \hich\af2\dbch\af31505\loch\f2 A disability medical impairment or chronic\hich\af2\dbch\af31505\loch\f2 health condition doesn't necessarily diminish the individual's knowledge, skills and abilities. \par \hich\af2\dbch\af31505\loch\f2 The impact of being out of work long\_term includes two to three times risk of poor health with increased High blood pressure, \par \hich\af2\dbch\af31505\loch\f2 Heart, disease, cancer, and a tw\hich\af2\dbch\af31505\loch\f2 o to three health risk of mental health such as depression. \par \hich\af2\dbch\af31505\loch\f2 And also a 20 percent increase in death risk. \par \hich\af2\dbch\af31505\loch\f2 Just because a person has a disabling condition and limitation does not mean that they need \par \hich\af2\dbch\af31505\loch\f2 To become disabled in the sense of leaving the workforce. \par \hich\af2\dbch\af31505\loch\f2 What we would ask you to do, really, is to support the individuals focus on what activities they can do. \par \hich\af2\dbch\af31505\loch\f2 And the goals they want to achieve during recovery. \par \hich\af2\dbch\af31505\loch\f2 Help along recovery can really help people understand how they can become more employ able in the \hich\af2\dbch\af31505\loch\f2 future. \par \hich\af2\dbch\af31505\loch\f2 We always suggest they use this time productively. \par \hich\af2\dbch\af31505\loch\f2 This entire process of stay\_at\_work and return\_to\_work is really what I call disrupting disability. \par \hich\af2\dbch\af31505\loch\f2 We really need to help an individual with a disability or a chronic health condition or impairmen\hich\af2\dbch\af31505\loch\f2 t \par \hich\af2\dbch\af31505\loch\f2 And their family to disrupt disability. \par \hich\af2\dbch\af31505\loch\f2 As I said, just because they have this medical condition really doesn't diminish the person's past experiences \par \hich\af2\dbch\af31505\loch\f2 Their knowledge, and their skills. \par \hich\af2\dbch\af31505\loch\f2 If we could go to the next slide, please. \par \hich\af2\dbch\af31505\loch\f2 Really the medical role \hich\af2\dbch\af31505\loch\f2 or the medical professional is really a vital part of the SAW and Return\_to\_work team. \par \hich\af2\dbch\af31505\loch\f2 While differing by composition, the typical team is a return to work coordinator \par \hich\af2\dbch\af31505\loch\f2 A worker's compensation staff, the individual's supervisor and an accommodation subject\hich\af2\dbch\af31505\loch\f2 matter expert. \par \hich\af2\dbch\af31505\loch\f2 The clinical role of a medical professional on the team is really the provision of medical opinion \par \hich\af2\dbch\af31505\loch\f2 In support of early SAW and return\_to\_work interventions. \par \hich\af2\dbch\af31505\loch\f2 What the team really needs to know in moving forward in this process is the nature\hich\af2\dbch\af31505\loch\f2 , degree, \par \hich\af2\dbch\af31505\loch\f2 And the prognosis of the disabling the potentially \hich\af2\dbch\af31505\loch\f2 disabling condition. \par \hich\af2\dbch\af31505\loch\f2 I'll just also note that oftentimes medical professionals are asked to fill out return\_to\_work functional assessment forms \par \hich\af2\dbch\af31505\loch\f2 Physical capacity assessment forms, mental health functional assessment \par \hich\af2\dbch\af31505\loch\f2 And fitness for duty return\_to\_work releases. \par \hich\af2\dbch\af31505\loch\f2 And all these forms enable the stay\_at\_work and return\_to\_work process to proceed. \par \hich\af2\dbch\af31505\loch\f2 But we know that medical professionals are very busy a\hich\af2\dbch\af31505\loch\f2 nd, you know, the challenge really is getting \par \hich\af2\dbch\af31505\loch\f2 These forms completed and understanding really, the nature, degree, prognosis. \par \hich\af2\dbch\af31505\loch\f2 So that everyone can begin thinking about the implications for the person, for their job position \par \hich\af2\dbch\af31505\loch\f2 And for also for future reassignment for other positions if that becomes an option. \par \hich\af2\dbch\af31505\loch\f2 So if we could go to the next slide, please. \par \hich\af2\dbch\af31505\loch\f2 There are three major point in\hich\af2\dbch\af31505\loch\f2 this process where you as a medical professional may be pulled in. \par \hich\af2\dbch\af31505\loch\f2 Your opinion first may be re\hich\af2\dbch\af31505\loch\f2 quested to initiate the transition duty process. \par \hich\af2\dbch\af31505\loch\f2 One in which one or more temporary accommodations or adjustments are provided so an employee \par \hich\af2\dbch\af31505\loch\f2 Can perform job duties while recovery from a medical condition. \par \hich\af2\dbch\af31505\loch\f2 This really enables the person to return to emplo\hich\af2\dbch\af31505\loch\f2 yment as soon as they're medically stable. \par \hich\af2\dbch\af31505\loch\f2 And perform the tasks they have been performing in the past safely. \par \hich\af2\dbch\af31505\loch\f2 So during this process the essential functions of the job of an injured or ill individual may be eliminated. \par \hich\af2\dbch\af31505\loch\f2 That's all part of this transitional\hich\af2\dbch\af31505\loch\f2 duty process. \par \hich\af2\dbch\af31505\loch\f2 The result is the individual returns to their job without restrictions or accommodations. \par \hich\af2\dbch\af31505\loch\f2 And really that's the ideal or the optimal outcome of the transitional duty. \par \hich\af2\dbch\af31505\loch\f2 You may also be brought in later in the transitional duty process when it'\hich\af2\dbch\af31505\loch\f2 s determined an individual \par \hich\af2\dbch\af31505\loch\f2 Has reached maximum recovery. \par \hich\af2\dbch\af31505\loch\f2 And now it's discovered that the individual has a permanent medical condition. \par \hich\af2\dbch\af31505\loch\f2 At this point, the ADA may require the Americans with Disabilities Act. \par \hich\af2\dbch\af31505\loch\f2 And then support is really needed in determinin\hich\af2\dbch\af31505\loch\f2 g what accommodations will enable the individual to perform \par \hich\af2\dbch\af31505\loch\f2 The essential functions of the position. \par \hich\af2\dbch\af31505\loch\f2 So this is the business of returning the individual back to his former position, but in this circumstance \par \hich\af2\dbch\af31505\loch\f2 It's with an accommodation. \par \hich\af2\dbch\af31505\loch\f2 And then finally, t\hich\af2\dbch\af31505\loch\f2 here's another point of engagement where your services may be requested. \par \hich\af2\dbch\af31505\loch\f2 And that is we may be asking you to provide information in order to determine what accommodations \par \hich\af2\dbch\af31505\loch\f2 Would enable the individual to perform the essential functions of a new position tha\hich\af2\dbch\af31505\loch\f2 t they're qualified for. \par \hich\af2\dbch\af31505\loch\f2 So under the ADA, what we attempt to do first is to accommodate the person in the current position. \par \hich\af2\dbch\af31505\loch\f2 And offering them an accommodation to meet the essential functions of their position. \par \hich\af2\dbch\af31505\loch\f2 If they're not able to do that, then sort of the last\_ditch effort to keep that person employed with this employer is called reassignment. \par \hich\af2\dbch\af31505\loch\f2 What we're looking at there we look again at the qualifications of the individual. \par \hich\af2\dbch\af31505\loch\f2 We want to compare those to the es\hich\af2\dbch\af31505\loch\f2 sential functions of jobs that may be open currently with the employer. \par \hich\af2\dbch\af31505\loch\f2 And then we do a job match. \par \hich\af2\dbch\af31505\loch\f2 And again, that's when you may be needed, because it's a new position, new essential functions. \par \hich\af2\dbch\af31505\loch\f2 And once again we may be asking you for your opinion, and pe\hich\af2\dbch\af31505\loch\f2 rhaps your ideas about what accommodations might work. \par \hich\af2\dbch\af31505\loch\f2 Ideally, the medical professional, yourself, listens carefully, treats, certifies appropriately. \par \hich\af2\dbch\af31505\loch\f2 And communicates with the workplace and the supports in order to provide a successful return\_to\_work out\hich\af2\dbch\af31505\loch\f2 come. \par \hich\af2\dbch\af31505\loch\f2 Next slide, please. \par \hich\af2\dbch\af31505\loch\f2 So if an individual is not able to return to work without limitations, then the workplace accommodations \par \hich\af2\dbch\af31505\loch\f2 Or adjustments as we sometimes call them, are really a key part of the solution. \par \hich\af2\dbch\af31505\loch\f2 So again, according to the American College\hich\af2\dbch\af31505\loch\f2 of Occupational and Environmental medicine, \par \hich\af2\dbch\af31505\loch\f2 They say a permanent or long\_term alteration of workplace capacity occurs. \par \hich\af2\dbch\af31505\loch\f2 ADA or reasonable accommodation process may be triggered. \par \hich\af2\dbch\af31505\loch\f2 It operates in parallel with stay at work and return to work process. \par \hich\af2\dbch\af31505\loch\f2 If the \hich\af2\dbch\af31505\loch\f2 ADA applies it will heavily influence what occurs during SAW and return\_to\_work. \par \hich\af2\dbch\af31505\loch\f2 Sometimes there's confusion caused, because once some companies have in their policy that as soon as the person \par \hich\af2\dbch\af31505\loch\f2 Is injured that immediately that triggers the ADA process. \par \hich\af2\dbch\af31505\loch\f2 So \hich\af2\dbch\af31505\loch\f2 there may be a parallel process. \par \hich\af2\dbch\af31505\loch\f2 So in the previous slide when I talk about the three points of engagement, the transition to return\_to\_work \par \hich\af2\dbch\af31505\loch\f2 Accommodations to a former position and accommodations to reassignment, it may not be as neat as that. \par \hich\af2\dbch\af31505\loch\f2 That we pro\hich\af2\dbch\af31505\loch\f2 gress from one stage to another. \par \hich\af2\dbch\af31505\loch\f2 There may be some overlap between. \par \hich\af2\dbch\af31505\loch\f2 So in some of the information you're providing, maybe shared multiple times on multiple forms. \par \hich\af2\dbch\af31505\loch\f2 Which we know is cumbersome and sometimes challenging for you. \par \hich\af2\dbch\af31505\loch\f2 Let's go to the next slide, pl\hich\af2\dbch\af31505\loch\f2 ease. \par \hich\af2\dbch\af31505\loch\f2 So let's talk really what I'm talking about in terms of accommodation. \par \hich\af2\dbch\af31505\loch\f2 Or in some contexts they call it an adjustment. \par \hich\af2\dbch\af31505\loch\f2 So really this is any modification or adjustment to the job or the work environment that enables \par \hich\af2\dbch\af31505\loch\f2 A qualified person with a disability to apply for or perform a job. \par \hich\af2\dbch\af31505\loch\f2 Earlier when I talked about disrupting the disabling of an employee, \par \hich\af2\dbch\af31505\loch\f2 Accommodations really serve that purpose. \par \hich\af2\dbch\af31505\loch\f2 So again, our focus needs to be on what the person can do as opposed to what\hich\af2\dbch\af31505\loch\f2 they can't. \par \hich\af2\dbch\af31505\loch\f2 And a disability, medical impairment, a chronic health condition doesn't necessarily diminish the individual's knowledge \par \hich\af2\dbch\af31505\loch\f2 Skills, and abilities as I've said previously. \par \hich\af2\dbch\af31505\loch\f2 So let's talk a little bit about the accommodation process. \par \hich\af2\dbch\af31505\loch\f2 So what really\hich\af2\dbch\af31505\loch\f2 is that process? \par \hich\af2\dbch\af31505\loch\f2 It's simply a problem\_solving process used in this case by a stay\_at\_work and return\_to\_work professionals \par \hich\af2\dbch\af31505\loch\f2 To keep the individual engaged in the workplace. \par \hich\af2\dbch\af31505\loch\f2 The process is as follows: \par \hich\af2\dbch\af31505\loch\f2 You simply analyze the particular job involved. \par \hich\af2\dbch\af31505\loch\f2 That\hich\af2\dbch\af31505\loch\f2 usually involves having a job description, and reviewing the essential functions of that position. \par \hich\af2\dbch\af31505\loch\f2 Consulting with an individual to assert the precise and job\_related limitations and how they can be addressed. \par \hich\af2\dbch\af31505\loch\f2 And again, this is where your \_\_ where inform\hich\af2\dbch\af31505\loch\f2 ation from a medical professional comes in. \par \hich\af2\dbch\af31505\loch\f2 Oftentimes that person takes a form, which I'll show you in a couple of minutes, to the physician, to the medical professional. \par \hich\af2\dbch\af31505\loch\f2 And asks you to fill out what you believe the job\_related limitations are. \par \hich\af2\dbch\af31505\loch\f2 Then ofte\hich\af2\dbch\af31505\loch\f2 ntimes what we'll do is we'll work in consultation with the person, and perhaps the job accommodation network. \par \hich\af2\dbch\af31505\loch\f2 Which I will talk about later. \par \hich\af2\dbch\af31505\loch\f2 And we identify the potential accommodations and really begin to assess their effectiveness. \par \hich\af2\dbch\af31505\loch\f2 And accommodations, a\hich\af2\dbch\af31505\loch\f2 gain, may be come into play in looking \_\_ if a person can do their current job. \par \hich\af2\dbch\af31505\loch\f2 If they need to do a job with accommodations, or if they really need to be reassigned to another position. \par \hich\af2\dbch\af31505\loch\f2 Next, what we'll do is we'll select and implement the most appropriat\hich\af2\dbch\af31505\loch\f2 e accommodation for the person as well as for the employer. \par \hich\af2\dbch\af31505\loch\f2 If we could go to the next slide, please. \par \hich\af2\dbch\af31505\loch\f2 So really, the medical professional's role in the accommodation includes determining limitations. \par \hich\af2\dbch\af31505\loch\f2 Or how the disability affect the individual's capacity to learn or to perform the job's essential functions effectively. \par \hich\af2\dbch\af31505\loch\f2 And just to let you know, I mean essential functions are employer\_determined. \par \hich\af2\dbch\af31505\loch\f2 And these are duties that are regarded as crucial to the \hich\af2\dbch\af31505\loch\f2 job that someone has, or that someone desires to have. \par \hich\af2\dbch\af31505\loch\f2 So you're also very helpful in really determining accommodations or adjustments that a person may need to perform these essential functions. \par \hich\af2\dbch\af31505\loch\f2 So it's helpful in your learned experience for us to know wh\hich\af2\dbch\af31505\loch\f2 at has or hasn't worked \_\_ both in your experience as a medical professional \par \hich\af2\dbch\af31505\loch\f2 And then perhaps with you engaging with the individual for you to mutually understand what limitations are most prominent \par \hich\af2\dbch\af31505\loch\f2 And what accommodations may have worked for that person. \par \hich\af2\dbch\af31505\loch\f2 Perhaps that person shares more information with you than a return\_to\_work professional or with their employer. \par \hich\af2\dbch\af31505\loch\f2 So really we need everybody's help in understanding where the employee has been, what perhaps accommodations have worked \par \hich\af2\dbch\af31505\loch\f2 For them in the past\hich\af2\dbch\af31505\loch\f2 and what in relation to their limitations might work in the future. \par \hich\af2\dbch\af31505\loch\f2 If we could go to the next slide, please. \par \hich\af2\dbch\af31505\loch\f2 One more slide. \par \hich\af2\dbch\af31505\loch\f2 All right. \par \hich\af2\dbch\af31505\loch\f2 So what we would also ask you to do is to provide resources to the patient on stay\_at\_work and return\_to\_work. \par \hich\af2\dbch\af31505\loch\f2 There i\hich\af2\dbch\af31505\loch\f2 s really a robust foundation for stay\_at\_work and return\_to\_work in the country. \par \hich\af2\dbch\af31505\loch\f2 It's just a matter of those \_\_ that individual tapping into, and the employer tapping into the resources. \par \hich\af2\dbch\af31505\loch\f2 We have first the job accommodation network. \par \hich\af2\dbch\af31505\loch\f2 That is a free resource. \par \hich\af2\dbch\af31505\loch\f2 I will talk about a little bit later. \par \hich\af2\dbch\af31505\loch\f2 Locally, you have the Shirley Ryan 嫩B研究院 with vocational rehab services, \par \hich\af2\dbch\af31505\loch\f2 Assistive technology services, and then also the Illinois Department of Rehab Services. \par \hich\af2\dbch\af31505\loch\f2 All of these are part of that safety net or that n\hich\af2\dbch\af31505\loch\f2 et of services for when someone is injured and attempting to return to work. \par \hich\af2\dbch\af31505\loch\f2 If we could go to the next slide, please. \par \hich\af2\dbch\af31505\loch\f2 So what I just wanted to put up on the screen for you is to see what form, which is typically provided to you. \par \hich\af2\dbch\af31505\loch\f2 And what we need \hich\af2\dbch\af31505\loch\f2 completed in order to move forward in this stay\_at\_work return\_to\_work process. \par \hich\af2\dbch\af31505\loch\f2 As I said, unfortunately, there are a number of forms specific to specific processes. \par \hich\af2\dbch\af31505\loch\f2 But this is the one that usually typically starts the accommodation process. \par \hich\af2\dbch\af31505\loch\f2 And this form\hich\af2\dbch\af31505\loch\f2 really helps employers make decisions as to whether or not the person is covered by the ADA. \par \hich\af2\dbch\af31505\loch\f2 And what accommodations may work for the limitations specified. \par \hich\af2\dbch\af31505\loch\f2 And just to let you know that as a medical professional, I know that medical professionals are oft\hich\af2\dbch\af31505\loch\f2 en somewhat timid and shy \par \hich\af2\dbch\af31505\loch\f2 Really to say that a person is covered by the ADA or not. \par \hich\af2\dbch\af31505\loch\f2 I know that many employers ask you to make that decision. \par \hich\af2\dbch\af31505\loch\f2 But I'm here to tell you that that really isn't your decision. \par \hich\af2\dbch\af31505\loch\f2 That's the employer's decision. \par \hich\af2\dbch\af31505\loch\f2 So it's not your r\hich\af2\dbch\af31505\loch\f2 esponsibility, and you are not liable for that decision. \par \hich\af2\dbch\af31505\loch\f2 But you can in your best medical opinion provide information that the employer needs. \par \hich\af2\dbch\af31505\loch\f2 Again, totally the employer's responsibility in making these types of determinations. \par \hich\af2\dbch\af31505\loch\f2 And I know that the form is\hich\af2\dbch\af31505\loch\f2 rather small on the screen. \par \hich\af2\dbch\af31505\loch\f2 But for instance, it asks you if the limitations involve any major life activities. \par \hich\af2\dbch\af31505\loch\f2 And there are just various boxes that you can tick off in determining whether they do affect any major bodily functions. \par \hich\af2\dbch\af31505\loch\f2 And then also just the\hich\af2\dbch\af31505\loch\f2 re are a number of questions about the limitations that the person has. \par \hich\af2\dbch\af31505\loch\f2 And again any accommodations you might be aware of in your experience that you've heard either from other patients \par \hich\af2\dbch\af31505\loch\f2 That you've had, other professionals that you've worked with, or eve\hich\af2\dbch\af31505\loch\f2 n if the individual raised perhaps accommodations \par \hich\af2\dbch\af31505\loch\f2 Which may have worked in the past for them or may not have worked in the past. \par \hich\af2\dbch\af31505\loch\f2 We also ask you for that information. \par \hich\af2\dbch\af31505\loch\f2 If we could go to the next slide, please. \par \hich\af2\dbch\af31505\loch\f2 So what I wanted to do now is just to really f\hich\af2\dbch\af31505\loch\f2 amiliarize \_\_ if you're not really have had experience with accommodations before \par \hich\af2\dbch\af31505\loch\f2 And you're kind of familiar with a category of accommodations or the types of accommodations. \par \hich\af2\dbch\af31505\loch\f2 I just wanted to go through a few categories of them. \par \hich\af2\dbch\af31505\loch\f2 One of them is what we ca\hich\af2\dbch\af31505\loch\f2 ll the HR accommodations. \par \hich\af2\dbch\af31505\loch\f2 And these are flexible work arrangements. \par \hich\af2\dbch\af31505\loch\f2 They could be part\_time schedules. \par \hich\af2\dbch\af31505\loch\f2 They could be policies or benefit changes that would enable the person to return to work. \par \hich\af2\dbch\af31505\loch\f2 Or leave. \par \hich\af2\dbch\af31505\loch\f2 And what many of us are doing these days, of course,\hich\af2\dbch\af31505\loch\f2 in these COVID times is really telework. \par \hich\af2\dbch\af31505\loch\f2 And one of the things that I'll caution you particularly with HR accommodations is that supervisors \par \hich\af2\dbch\af31505\loch\f2 Often prefer leave, because it is the easiest type of accommodation provided. \par \hich\af2\dbch\af31505\loch\f2 However, it's not usually the best \hich\af2\dbch\af31505\loch\f2 by the employer or by the individual with the disability. \par \hich\af2\dbch\af31505\loch\f2 So really I caution that while leave may again be the simplest option, it's often the most counterproductive. \par \hich\af2\dbch\af31505\loch\f2 For the individual it may result in comorbidities while off of work. \par \hich\af2\dbch\af31505\loch\f2 Or for the employer\hich\af2\dbch\af31505\loch\f2 is may mean paying both the employee and perhaps a temporary replacement. \par \hich\af2\dbch\af31505\loch\f2 Offering reasonable and medically suitable work is always preferable to leave. \par \hich\af2\dbch\af31505\loch\f2 And that's what the research says and certainly what us who have been working in the field say as well. \par \hich\af2\dbch\af31505\loch\f2 So be cautious that if someone \_\_ if an employer consistently comes, or even the individual is coming to you and saying, \par \hich\af2\dbch\af31505\loch\f2 Well, no, I just want to take a leave. \par \hich\af2\dbch\af31505\loch\f2 Just maybe prod a little bit further. \par \hich\af2\dbch\af31505\loch\f2 Don't just sign off on that quickly. \par \hich\af2\dbch\af31505\loch\f2 Prod a little furt\hich\af2\dbch\af31505\loch\f2 her and let's see why they prefer leave. \par \hich\af2\dbch\af31505\loch\f2 Perhaps it is really the option that's needed at the moment. \par \hich\af2\dbch\af31505\loch\f2 But I can just tell you that it's one that is chosen way too often. \par \hich\af2\dbch\af31505\loch\f2 And again, really counterproductive. \par \hich\af2\dbch\af31505\loch\f2 So next \_\_ the next slide, please. \par \hich\af2\dbch\af31505\loch\f2 Okay. \par \hich\af2\dbch\af31505\loch\f2 So the w\hich\af2\dbch\af31505\loch\f2 orkplace adjustments and equipment. \par \hich\af2\dbch\af31505\loch\f2 So these are really environmental adjustments. \par \hich\af2\dbch\af31505\loch\f2 More apt to falling and you want to keep them at work\hich\af2\dbch\af31505\loch\f2 or perhaps they're returning to work after a surgery. \par \hich\af2\dbch\af31505\loch\f2 Then perhaps they need to be closer to a restroom. \par \hich\af2\dbch\af31505\loch\f2 This might be in the same circumstance with somebody with diabetes. \par \hich\af2\dbch\af31505\loch\f2 It maybe also the case that we want to offer ergonomic products such as a sit\_stan\hich\af2\dbch\af31505\loch\f2 d desk or stool. \par \hich\af2\dbch\af31505\loch\f2 While mental health impairments these days seem to be one of the most prevalent health condition and disability \par \hich\af2\dbch\af31505\loch\f2 That we deal with, back impairments, motor impairments are still often occurring in the workplace. \par \hich\af2\dbch\af31505\loch\f2 And we find more and more p\hich\af2\dbch\af31505\loch\f2 eople asking for these desks and stools. \par \hich\af2\dbch\af31505\loch\f2 Or perhaps automatic door openers for people who do have medical impairments. \par \hich\af2\dbch\af31505\loch\f2 Who have been \_\_ who are wheelchair users, who are paraplegic or quadriplegic. \par \hich\af2\dbch\af31505\loch\f2 Or really just with somebody \hich\af2\dbch\af31505\loch\f2 with cerebral pal\hich\af2\dbch\af31505\loch\f2 sy, an automatic door opener can be very, very helpful \par \hich\af2\dbch\af31505\loch\f2 In returning them to work. \par \hich\af2\dbch\af31505\loch\f2 The next slide, please. \par \hich\af2\dbch\af31505\loch\f2 And the category of communication accessibility accommodations, there are all sorts of different accommodations. \par \hich\af2\dbch\af31505\loch\f2 Such as closed captioning, large fon\hich\af2\dbch\af31505\loch\f2 t, braille format, digital formats, HTML postcards, providing written instructions. \par \hich\af2\dbch\af31505\loch\f2 Video phones, CART, amplified headsets, \hich\af2\dbch\af31505\loch\f2 interpreters. \par \hich\af2\dbch\af31505\loch\f2 So this is rather a full array of those communication accessibility accommodations that one might need if\hich\af2\dbch\af31505\loch\f2 , for instance, \par \hich\af2\dbch\af31505\loch\f2 I'm blind and at work, or I lose my hearing at work. \par \hich\af2\dbch\af31505\loch\f2 Or I'm in an accident and lose my sight or hearing. \par \hich\af2\dbch\af31505\loch\f2 Can we go to the next slide, please?. \par \hich\af2\dbch\af31505\loch\f2 So there's all sorts of assistive technologies out there these days. \par \hich\af2\dbch\af31505\loch\f2 The technology is very soph\hich\af2\dbch\af31505\loch\f2 isticated. \par \hich\af2\dbch\af31505\loch\f2 And at this point, many of the technologies such as screen magnification or screen\_reading software. \par \hich\af2\dbch\af31505\loch\f2 Operable within operating systems on computers. \par \hich\af2\dbch\af31505\loch\f2 Many bugs have been worked out over the past decade, and are very effective in bringing someone \par \hich\af2\dbch\af31505\loch\f2 Who is losing their sight or someone who has lost their sight to enable them to do their job. \par \hich\af2\dbch\af31505\loch\f2 If \hich\af2\dbch\af31505\loch\f2 it is one of those white collar jobs that's information sharing, and they're using computer systems. \par \hich\af2\dbch\af31505\loch\f2 And there are iPads with apps. \par \hich\af2\dbch\af31505\loch\f2 There's various\hich\af2\dbch\af31505\loch\f2 apps which enable \_\_ which have accessibility features which really enable people \par \hich\af2\dbch\af31505\loch\f2 To work their jobs if it is, again, a computer\_based job. \par \hich\af2\dbch\af31505\loch\f2 There's alternate keyboards for someone for instance who has cumulative trauma disorder. \par \hich\af2\dbch\af31505\loch\f2 Alternate mice, same cond\hich\af2\dbch\af31505\loch\f2 ition. \par \hich\af2\dbch\af31505\loch\f2 Text highlighting software for someone who perhaps has a cognitive impairment from a stroke. \par \hich\af2\dbch\af31505\loch\f2 Who has been in a car accident. \par \hich\af2\dbch\af31505\loch\f2 As well as voice input software. \par \hich\af2\dbch\af31505\loch\f2 For instance, again, someone who has injured their arms or their hands, and they're no long\hich\af2\dbch\af31505\loch\f2 er able to input \par \hich\af2\dbch\af31505\loch\f2 As they have in the past, there's now voice input software. \par \hich\af2\dbch\af31505\loch\f2 And again, over the last 20 years, this technology has really become increasingly effective. \par \hich\af2\dbch\af31505\loch\f2 And very quickly for the person to train. \par \hich\af2\dbch\af31505\loch\f2 So they're able just to speak into their co\hich\af2\dbch\af31505\loch\f2 mputers and it's able to capture it. \par \hich\af2\dbch\af31505\loch\f2 As a medical professional, I'm sure you're very adept at these kinds of technologies. \par \hich\af2\dbch\af31505\loch\f2 If we could go to the next slide, please. \par \hich\af2\dbch\af31505\loch\f2 So there's also electronic information accessibility. \par \hich\af2\dbch\af31505\loch\f2 And this is more of sort of text or a\hich\af2\dbch\af31505\loch\f2 lternatives or captions for non\_text media. \par \hich\af2\dbch\af31505\loch\f2 So if I am someone who is blind, I am in a training such as this. \par \hich\af2\dbch\af31505\loch\f2 And I need this information to perform the essential functions of my job. \par \hich\af2\dbch\af31505\loch\f2 Then we in the field and we have been training others to ensure that if \hich\af2\dbch\af31505\loch\f2 there are graphics on these slides \par \hich\af2\dbch\af31505\loch\f2 That we want to make sure that there's alternate text behind \hich\af2\dbch\af31505\loch\f2 There's also techniques that one can use to traverse the page from the keyboard. \par \hich\af2\dbch\af31505\loch\f2 So there are keyboard shortcut that is somebody who \hich\af2\dbch\af31505\loch\f2 is disabled can use. \par \hich\af2\dbch\af31505\loch\f2 That enables them to function and move as quickly as us who are nondisabled in that way \par \hich\af2\dbch\af31505\loch\f2 Through documents and forms and such. \par \hich\af2\dbch\af31505\loch\f2 And also there's technology that can give users control over which features to load and to change. \par \hich\af2\dbch\af31505\loch\f2 And this \hich\af2\dbch\af31505\loch\f2 is particularly pertinent to website accessibility. \par \hich\af2\dbch\af31505\loch\f2 So again, with us functioning, with many tools that are web\_based these days, it can give someone who is blind \par \hich\af2\dbch\af31505\loch\f2 The ability to go directly to the pertinent information that's important to their job, and c\hich\af2\dbch\af31505\loch\f2 an avoid their screen \par \hich\af2\dbch\af31505\loch\f2 Reader going and reading all of the various captions that are really containing not information that are pertinent or relevant to their jobs. \par \hich\af2\dbch\af31505\loch\f2 And these tools, again, have become very effective over the years. \par \hich\af2\dbch\af31505\loch\f2 And there's also design \hich\af2\dbch\af31505\loch\f2 page text with sufficient contrast. \par \hich\af2\dbch\af31505\loch\f2 Contrast being another issue that many people with various disabilities deal with. \par \hich\af2\dbch\af31505\loch\f2 And there are tools these days built into Microsoft Windows, built into Apple products that one can set \par \hich\af2\dbch\af31505\loch\f2 As a person with a disability. \par \hich\af2\dbch\af31505\loch\f2 A\hich\af2\dbch\af31505\loch\f2 nd then from now on, any information received through that software program or that hardware is set to what I need \par \hich\af2\dbch\af31505\loch\f2 To see or hear, and it enables me, again, to do the essential functions of the job. \par \hich\af2\dbch\af31505\loch\f2 If we could go to the next slide, please. \par \hich\af2\dbch\af31505\loch\f2 So often we he\hich\af2\dbch\af31505\loch\f2 ar myths, and we hear questions about accommodations. \par \hich\af2\dbch\af31505\loch\f2 And there are a lot of misconceptions out there. \par \hich\af2\dbch\af31505\loch\f2 There are a lot of misconceptions that accommodations really cost too much. \par \hich\af2\dbch\af31505\loch\f2 And are cost prohibitive, and I'm not really even going to recommend them. \par \hich\af2\dbch\af31505\loch\f2 An\hich\af2\dbch\af31505\loch\f2 d as employers I'm not going to embrace them. \par \hich\af2\dbch\af31505\loch\f2 And then also there's a lot of myths out there in terms of effectiveness. \par \hich\af2\dbch\af31505\loch\f2 So the job accommodation network, a free consulting service of the Department of Labor, \par \hich\af2\dbch\af31505\loch\f2 Annually goes back to all of their employer cus\hich\af2\dbch\af31505\loch\f2 tomers, and they really ask them what was the cost of accommodation. \par \hich\af2\dbch\af31505\loch\f2 And this report is put out annually in September for October's National Disability Employment Awareness Month. \par \hich\af2\dbch\af31505\loch\f2 And what the last research reveals is that most \_\_ 58 percent of accommod\hich\af2\dbch\af31505\loch\f2 ations cost nothing to make whatsoever. \par \hich\af2\dbch\af31505\loch\f2 So when we're really talking about those accommodations that cost nothing, \par \hich\af2\dbch\af31505\loch\f2 We're really talking about those HR accommodations. \par \hich\af2\dbch\af31505\loch\f2 So we're talking about giving a more flexible schedule. \par \hich\af2\dbch\af31505\loch\f2 We're talking about enabling a p\hich\af2\dbch\af31505\loch\f2 erson to use leave as needed to return to work over those next couple of months during rehabilitation. \par \hich\af2\dbch\af31505\loch\f2 And if those that do occur \_\_ of those accommodations that do occur, the typical cost is only $500. \par \hich\af2\dbch\af31505\loch\f2 If we could go to the next slide. \par \hich\af2\dbch\af31505\loch\f2 Now in terms of the\hich\af2\dbch\af31505\loch\f2 impact of accommodations, the survey results consistently have shown benefits \par \hich\af2\dbch\af31505\loch\f2 Employers receive for making workplace accommodations far out\hich\af2\dbch\af31505\loch\f2 weigh the associated costs. \par \hich\af2\dbch\af31505\loch\f2 So 85 percent of employers who participated in the JAN survey have really \_\_ \par \hich\af2\dbch\af31505\loch\f2 Survey i\hich\af2\dbch\af31505\loch\f2 s called JAN for accommodation information. \par \hich\af2\dbch\af31505\loch\f2 And they've really \_\_ 74 percent of those employers reported that accommodations are either very effective \par \hich\af2\dbch\af31505\loch\f2 Or extremely effective. \par \hich\af2\dbch\af31505\loch\f2 And employers reporting providing accommodations that resulted in such benefits \hich\af2\dbch\af31505\loch\f2 in retaining. \par \hich\af2\dbch\af31505\loch\f2 And I'm sorry. \par \hich\af2\dbch\af31505\loch\f2 I'm messing up a little here. \par \hich\af2\dbch\af31505\loch\f2 Employers reported in this survey indirect benefits and direct benefits whenever they are surveyed. \par \hich\af2\dbch\af31505\loch\f2 And some of the benefits really are retaining valuable employees. \par \hich\af2\dbch\af31505\loch\f2 Improving productivity and mora\hich\af2\dbch\af31505\loch\f2 le. \par \hich\af2\dbch\af31505\loch\f2 Reducing workplace accommodations and training costs. \par \hich\af2\dbch\af31505\loch\f2 And improving company overall diversity. \par \hich\af2\dbch\af31505\loch\f2 So if we could go to the next slide, please. \par \hich\af2\dbch\af31505\loch\f2 resource as I stated before. \par \hich\af2\dbch\af31505\loch\f2 And JAN's consultants, they are professional consultants, all masters and Ph.D. level consultants. \par \hich\af2\dbch\af31505\loch\f2 And provid\hich\af2\dbch\af31505\loch\f2 e one on\_one counselling within specific industries. \par \hich\af2\dbch\af31505\loch\f2 There's also a self\_service portal to search JAN's vast resources to accommodation solutions. \par \hich\af2\dbch\af31505\loch\f2 So the graphic here is the front page of the JAN website. \par \hich\af2\dbch\af31505\loch\f2 In the top header, one can see that there's an A\_Z. \par \hich\af2\dbch\af31505\loch\f2 But going into that A\_Z, one can search accommodation options by \_\_ and let's go to the next slide, please. \par \hich\af2\dbch\af31505\loch\f2 So when you hit the A\_Z of Disabilities and Accommodations. \par \hich\af2\dbch\af31505\loch\f2 Then you're taken to a page and you can search by disability, limitation, work\_related \hich\af2\dbch\af31505\loch\f2 function, topic, or accommodation. \par \hich\af2\dbch\af31505\loch\f2 And what you basically receive is, for instance, in the graphic on the screen, we can see in the \hich\af2\dbch\af31505\loch\f2 If we can go to the next slide, please. \par \hich\af2\dbch\af31505\loch\f2 I also wanted to make everyone aware that we are in the process\hich\af2\dbch\af31505\loch\f2 of a number of demonstration projects \par \hich\af2\dbch\af31505\loch\f2 Regarding stay\_at\_work and return\_to\_work. \par \hich\af2\dbch\af31505\loch\f2 And we're really looking for state models of how best to create a \_\_ some systemic change \par \hich\af2\dbch\af31505\loch\f2 Within the state, with all the parties involved. \par \hich\af2\dbch\af31505\loch\f2 And to look at developing these m\hich\af2\dbch\af31505\loch\f2 odels and then of course replicating them throughout the country. \par \hich\af2\dbch\af31505\loch\f2 Now the pandemic, of course, has waylaid much of the work of the projects. \par \hich\af2\dbch\af31505\loch\f2 Particularly since these projects really involve some very large medical institutions throughout the country. \par \hich\af2\dbch\af31505\loch\f2 So re\hich\af2\dbch\af31505\loch\f2 ally stay tuned for the results of these projects. \par \hich\af2\dbch\af31505\loch\f2 But again, the intent is to bring together all of the parties within the stakeholder group in stay\_at\_work and return\_to\_work. \par \hich\af2\dbch\af31505\loch\f2 And look at some pretty major systemic change to more effectively ensure that \hich\af2\dbch\af31505\loch\f2 people are returned to work. \par \hich\af2\dbch\af31505\loch\f2 Or enabled to stay at work, so that we disrupt that disability process. \par \hich\af2\dbch\af31505\loch\f2 So that people while they may remain with an impairment, they may in the future have some sort of chronic health condition \par \hich\af2\dbch\af31505\loch\f2 Related to their illness \hich\af2\dbch\af31505\loch\f2 or injury. \par \hich\af2\dbch\af31505\loch\f2 But that doesn't mean that they become totally disabled and that they're not able to work any longer. \par \hich\af2\dbch\af31505\loch\f2 So that's the kind of exploration that we're going to do with these eight demonstration projects throughout the country. \par \hich\af2\dbch\af31505\loch\f2 So we're hoping once w\hich\af2\dbch\af31505\loch\f2 e are out of the pandemic phase that we're able to move forward aggressively to work through these \par \hich\af2\dbch\af31505\loch\f2 Demonstration projects, and then have results in the next year or two. \par \hich\af2\dbch\af31505\loch\f2 So with that, I wanted to open it up to some questions. \par \hich\af2\dbch\af31505\loch\f2 And hopefully talking about the burdens. \par \hich\af2\dbch\af31505\loch\f2 As I say, what seems to be our challenge is that so many medical pr\hich\af2\dbch\af31505\loch\f2 ofessionals really have little to no familiarity. \par \hich\af2\dbch\af31505\loch\f2 It's not part of your training or your curriculum as a physician or as a medical professional. \par \hich\af2\dbch\af31505\loch\f2 That creates some issues of course. \par \hich\af2\dbch\af31505\loch\f2 But then we chronically hear of the burden of the paperwork as well. \par \hich\af2\dbch\af31505\loch\f2 Someth\hich\af2\dbch\af31505\loch\f2 ing we're all burdened by. \par \hich\af2\dbch\af31505\loch\f2 But it seems to be in particularly \_\_ a particular difficult to getting the various forms that are needed for this \par \hich\af2\dbch\af31505\loch\f2 Stay\_at\_work and return\_to\_work process completed. \par \hich\af2\dbch\af31505\loch\f2 And again, employer makes all of the decisions in terms of the ADA and how they want to move forward. \par \hich\af2\dbch\af31505\loch\f2 But again, with employers, they too really are not oftentimes very informed about the accommodation process. \par \hich\af2\dbch\af31505\loch\f2 And they are heavily relying on medical profe\hich\af2\dbch\af31505\loch\f2 ssionals to really make these really important decisions. \par \hich\af2\dbch\af31505\loch\f2 \hich\af2\dbch\af31505\loch\f2 And after a stroke or after a traumatic brain injury. \par \hich\af2\dbch\af31505\loch\f2 And so aphasia are people who have communication problems. \par \hich\af2\dbch\af31505\loch\f2 And, you know, it's very, very difficult \hich\af2\dbch\af31505\loch\f2 for them to return to work. \par \hich\af2\dbch\af31505\loch\f2 They are also often excluded from research studies that look at return\_to\_work. \par \hich\af2\dbch\af31505\loch\f2 And I'm just wondering if there's any chance that in any of the demonstration projects \par \hich\af2\dbch\af31505\loch\f2 People with aphasia might be included. \par \hich\af2\dbch\af31505\loch\f2 Obviously they need s\hich\af2\dbch\af31505\loch\f2 pecial strategies in order to be included in studies and demonstration projects. \par \hich\af2\dbch\af31505\loch\f2 But I just wanted to bring that up, because notoriously, we know from the fact that very few people with aphasia are able to return to work. \par \hich\af2\dbch\af31505\loch\f2 So I just want to bring that up as\hich\af2\dbch\af31505\loch\f2 , you know, consideration of that impairment moving forward. \par
